Terms

These terms cover the Damson app and this website. They are written to be read, so they are short. Using Damson means you accept them.

Damson is not medical advice

Damson is a companion for keeping your own record of what you eat and how it sat afterwards. It does not diagnose anything, it does not treat anything, and it does not prescribe anything. It cannot tell you whether a change is safe for you. Your clinician can, and if anything in the app conflicts with what they have told you, they are right and the app is wrong.

If you are unwell, or something new and worrying is happening, please speak to a doctor rather than to an app.

Estimates are estimates

When Damson reads a plate it produces an estimate, and it says so: the figures are prefaced with the word about, and you can correct any of them. Portion sizes, preparation, and recipes vary far more than any reading can account for. Treat the numbers as a rough note, not a measurement. The reading is produced by an automated model rather than by a person, and so is the answer the assistant gives you.

Your records are yours

You keep every right to what you write and photograph in Damson. We claim no ownership of it. We hold far less of it than you might expect, and the privacy policy says exactly what does reach us, what we keep afterwards, and for how long.

With your permission, Damson can read two things from Apple Health: how long you slept, and which days a period ran. It never writes anything back to Apple Health. You can switch the reading off at any time in the app, under My data, and the nights it had read are removed when you do.

What you agree to do

• Use Damson for yourself, not to make decisions for someone else.
• Do not try to break, overload, or work around the service, including the daily limits that keep it affordable for everyone.
• Do not copy the app, its content, or its citations for republication elsewhere without asking.
• When you type a question to the assistant, keep it to what Damson is for. Do not use it to produce anything unlawful or abusive, and do not try to talk it into acting as a clinician, because it is not one and it will not become one.

What is free, and what Premium adds

The record is free and stays free: logging a meal by search, barcode or description, one photo scan a day, the read that follows each meal, your cycle log, your symptoms and notes, the patterns Damson finds in your own days, the page for your appointment, and everything you have ever logged. Nothing you record is ever taken away or hidden behind a payment. Photo scans and questions to the assistant have a daily allowance, which is there so the running costs stay predictable and the app can stay free of advertisements.

Premium adds photo scans beyond the daily allowance, questions beyond the daily allowance, reading a menu, and the meal ideas deck. That is the whole list. Everything not named here is free.

Syncing your records through your own iCloud is free. It is on by default from the first day, so your records follow you to your other devices, and you can switch it off any time in the app, under You and then My data. Nothing is sold for it.

Paying for Premium

Premium is a subscription, sold in two lengths:

• Monthly, $9.99 per month.
• Yearly, $49.99 per year, with a free trial. The free trial is on the yearly plan only, and its length is shown on the purchase screen and by the App Store before you buy.

Prices are in US dollars and are what the App Store charges in the United States. In other countries the App Store shows you its own price in your own currency before you buy, and that price is the one that applies.

Both plans renew automatically at the end of each period, at the price above, until you cancel. Apple charges your account within 24 hours before each renewal. To cancel, go to your App Store account settings and turn off renewal at least 24 hours before the period ends. Cancelling stops the next charge and leaves Premium running until the period you have paid for is over.

If you take the free trial and then buy before it ends, the unused part of the trial is not carried over or refunded. That is Apple's rule for every app, not ours.

Purchases, renewals, cancellations and refunds are all Apple's. We never see your card details, we have no separate cancellation process of our own to get lost in, and refunds are requested from Apple under Apple's policy. If something has gone wrong, write to us anyway and we will help you sort it out.

Availability

We will keep the service running as well as we can, but we cannot promise it is never interrupted. Features that depend on a server, such as reading a plate, need a connection. Your own records stay readable on the device regardless.

Limits of our liability

Damson is provided as it is, without warranties beyond those the law gives you and does not allow us to exclude. To the extent the law permits, we are not liable for indirect or consequential loss arising from your use of the app or this website. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

Ending it

You can stop using Damson at any time by deleting the app, which also deletes your records from the device. We may suspend access that is damaging the service or other people's use of it.

Apple's part in this

These terms are between you and GPT Genius Lab, LLC. They are not between you and Apple, and Apple is not responsible for Damson or for anything in it. We are the ones responsible for the app, for supporting it, and for answering any claim that it does not work as it should, that it infringes somebody's rights, or that it falls short of a legal requirement. Apple has no obligation to support or maintain it.

You may use Damson on any Apple device you own or control, as the App Store's own rules allow. You agree that you are not in a country subject to a United States embargo or named on a United States restricted-party list.

Apple and its subsidiaries may enforce these terms against you as a third-party beneficiary of them.

If these terms change

When we change these terms we change the date at the top on the same day. If a change matters to you, because it affects what you are paying for or what you are agreeing to, we will say so in the app before it takes effect rather than quietly editing this page. Earlier versions are yours on request.

Law, and getting in touch

Damson is made by GPT Genius Lab, LLC, and these terms are governed by the law of the State of Delaware, United States, without limiting any consumer rights the law of your own country gives you. Questions about them go to [email protected].
